Welcome to Divinia Couture.
These Terms of Service ("Terms") apply to your use of the Divinia Couture website and to purchases made through our online store.
By using our website or placing an order, you agree to these Terms. If you do not agree with these Terms, please do not use the website or place an order.
These Terms do not limit any mandatory consumer rights that apply under Swedish, EU or other applicable law.
1. About Divinia Couture
Divinia Couture is a Sweden-based business offering handmade, made-to-order, customized and personalised clothing.
Our current contact information is provided on our website, at checkout and/or in your order confirmation.
These Terms are governed by applicable Swedish law, subject to any mandatory consumer protection laws that apply to you in your country of residence.
2. Who Can Place an Order
You must be at least 18 years old to place an order through our website, unless you have the consent of a parent or legal guardian where permitted by applicable law.
By placing an order, you confirm that the information you provide is accurate and that you are legally entitled to enter into a purchase contract.
If you place an order on behalf of another person or business, you confirm that you have the authority to do so.
3. Our Products
Our products are handmade and may be made to order.
We make reasonable efforts to ensure that product descriptions, photographs, measurements, materials, colours and other information displayed on the website are accurate.
However, handmade products may contain minor variations in:
Colour

Other characteristics resulting from the handmade production process
Minor variations that are inherent to handmade production and do not materially affect the product are not considered defects.
Colours displayed on a screen may also vary slightly depending on your device and screen settings.
4. Custom, Personalised and Made-to-Measure Orders
For custom, personalised or made-to-measure orders, you are responsible for providing accurate information, including measurements, design preferences, colour choices and other specifications requested by us.
We are not responsible for problems with fit or appearance that result from inaccurate, incomplete or incorrect information supplied by you.
Before placing a custom order, please carefully review all measurements and specifications you provide.
Where we identify a significant issue or require clarification regarding your specifications, we may contact you before production begins.
Custom or personalised products remain subject to applicable statutory rights concerning defective, faulty or incorrectly supplied goods.

All prices are displayed in the currency indicated on the website.
Applicable taxes, including VAT where required, will be displayed at checkout.

We accept the payment methods displayed at checkout.
Payment is processed through the payment provider available on our website. We do not store full payment card details unless expressly stated otherwise.

Any price change will not affect an order that has already been accepted and confirmed at the applicable price.
If an obvious pricing or product information error occurs on our website, we may contact you to clarify the error before fulfilling the order. Where required by applicable law, you will have the option to cancel the order and receive a full refund.

When you place an order, you will receive an automated order confirmation by email.
The order confirmation confirms that we have received your order. A binding purchase contract is formed when we accept your order in accordance with applicable law.
We may decline or cancel an order where reasonably necessary, including in circumstances such as:
The product is unavailable
We are unable to fulfil the order
Payment cannot be authorised
We identify a significant pricing or product information error

We will make reasonable efforts to accommodate your request before production or dispatch.
For custom, personalised or made-to-measure orders, changes may not be possible once work has begun.
However, nothing in this section limits any statutory right of withdrawal or other mandatory consumer right that applies to your purchase.
9. Right of Withdrawal – EU Consumers
If you are a consumer purchasing goods online within the European Union, you generally have a legal right to withdraw from your purchase within 14 days without giving a reason.
For goods, the withdrawal period normally begins when you, or a person designated by you other than the carrier, receives the goods.
You must notify us of your decision to withdraw before the 14-day period expires.
For full details, please see our Returns & Refunds Policy.
Your statutory right of withdrawal does not apply to certain products where a legal exception applies, including goods made according to the consumer's specifications or clearly personalised goods.
Simply making an item after an order has been placed does not automatically remove the statutory right of withdrawal.
10. Returns and Refunds
Our Returns & Refunds Policy explains:
How to exercise your right of withdrawal
Return deadlines
Return shipping costs
Refunds
Faulty and incorrect products
Custom and personalised products
Uncollected parcels
Exchanges
Please review our Returns & Refunds Policy before placing an order.
Nothing in our Returns & Refunds Policy limits your mandatory statutory consumer rights.
11. Faulty, Damaged or Incorrect Products
If you receive a product that is faulty, damaged or materially different from what you ordered, please contact us at:
Please provide your order number and, where appropriate, photographs showing the problem.
We will assess the issue and provide an appropriate remedy in accordance with applicable consumer law.
Depending on the circumstances and applicable law, this may include repair, replacement, price reduction or refund.
The legal rights available to consumers in relation to faulty or defective goods are separate from the voluntary or statutory 14-day right of withdrawal.
12. Shipping and Delivery
We currently ship to countries within the European Union.
Available delivery methods, shipping costs and estimated delivery times are displayed at checkout.
Delivery times are estimates unless a specific delivery date or period has been expressly agreed.
We are not responsible for delays caused by circumstances outside our reasonable control, such as carrier delays, customs procedures, strikes, extreme weather, natural disasters or other events beyond our reasonable control.
However, nothing in these Terms excludes or limits any mandatory rights you may have if an order is not delivered within the legally applicable period.
If your order appears to be delayed or lost, please contact us so that we can assist you in investigating the shipment.
13. Delivery Address
You are responsible for providing a complete and accurate delivery address.
We are not responsible for delays or additional costs resulting from incorrect or incomplete delivery information supplied by you.
If an order is returned to us because the address provided was incorrect or because the parcel was not collected, please contact us to discuss available options.
Any additional shipping costs for resending an order may be charged where permitted by applicable law.
14. Customs and Import Charges
For deliveries within the European Union, applicable taxes and charges will be handled in accordance with the delivery arrangement shown at checkout.
If we offer delivery to destinations where customs duties, import taxes or other charges may apply, these charges may be the responsibility of the customer unless otherwise stated at checkout.
You are responsible for complying with any applicable import requirements in your country.
15. Orders That Are Not Collected
If a parcel is not collected from the carrier or collection point and is returned to us, please contact us as soon as possible.
An uncollected parcel does not automatically constitute an exercise of your statutory right of withdrawal.
Where permitted by applicable law, we may charge reasonable costs actually incurred as a result of a failed delivery or return.
If you request that the order is shipped again, additional reasonable shipping costs may apply.
Nothing in this section limits your statutory consumer rights.

Nothing in these Terms limits your statutory rights as a consumer.
19. Events Beyond Our Reasonable Control
We will not be responsible for failure or delay in performing our obligations where the failure or delay results from circumstances beyond our reasonable control.
